1. General
These Terms & Conditions govern the sale of products and services provided by Ryzer Equipment (“Company”).
By purchasing from or engaging with the Company, the customer agrees to these terms.
2. Orders & Payment
All orders are subject to acceptance by the Company.
Payment terms will be outlined on the invoice or purchase agreement. Products may not ship until payment terms are satisfied.
The Company reserves the right to refuse or cancel orders at its discretion.
3. Pricing
All prices are subject to change without notice.
Quotes are valid for the time period stated on the quote. Taxes, shipping, duties, or additional fees may apply unless otherwise specified.
4. Shipping & Delivery
Delivery timelines are estimates only.
The Company is not liable for delays caused by carriers, supply chain disruptions, weather, or events beyond its control.
Risk of loss transfers to the customer upon shipment unless otherwise agreed in writing.
Customer must inspect products upon delivery and notify the Company in writing of any visible damage or shortages within five (5) business days of receipt.
5. Returns
Returns must be approved in writing prior to shipment.
Products must be unused and in original condition. Restocking fees may apply.
Custom or special-order items may not be eligible for return.
6. Warranty
Products may carry a limited manufacturer warranty where applicable.
Except as expressly stated in writing, products are provided “as is” without additional warranties, including any implied warranties of merchantability or fitness for a particular purpose.
The Company makes no additional warranties beyond those provided by the manufacturer unless stated in writing.
7. Limitation of Liability
The Company shall not be liable for indirect, incidental, special, or consequential damages including lost profits, crop loss, downtime, business interruption, or property damage arising from the use of its products.
To the maximum extent permitted by law, total liability shall not exceed the amount paid for the product in question.
8. Use of Equipment
Customer is responsible for:
Proper installation
Safe operation
Following all safety instructions
Compliance with local regulations
The Company is not responsible for misuse or improper installation.
9. Governing Law
These Terms are governed by the laws of Manitoba, Canada.
10. Changes to Terms
The Company may update these Terms at any time. Continued purchase or use constitutes acceptance of the current version.
11. Indemnification
Customer agrees to indemnify and hold the Company harmless from claims, damages, losses, or expenses arising from misuse, improper installation, modification, or failure to follow provided instructions or safety guidelines.
